1. Introduction

Browsing this Website, collecting information, and placing an Order represent the Buyer’s/User’s agreement to the Terms and Conditions (this document) displayed on this Website. If any of the clauses below are found to be null or invalid, regardless of the reason, that clause shall not affect the validity of the other clauses.

Seller – SC Maccetis SRL.

Buyer – a natural person or legal entity who places an Order.

Order – the Buyer communicates to the Seller, via the Website or by phone, their intention to purchase goods and services from the Website.

Account – the section of the Website (consisting of an email address, a password, the name/denomination, delivery and billing details and addresses, and the orders placed) that allows the Buyer to place orders.

User – any natural person or legal entity who browses and collects information from this Website or registers on this Website by completing the account creation process, thereby agreeing to the specific clauses of the Website contained in the Terms and Conditions section.

2. Contractual Documents

2.1 By placing an Order on the Website or by sending an Order by phone, email, or fax, the Buyer agrees to the means of communication—telephone, online, or email—through which the Seller conducts its commercial operations.

2.2 The notification received by the Buyer after placing the Order serves for informational purposes only and does not constitute acceptance of the Order. This notification is sent either electronically, via an automatically generated email from the Website, or by telephone.

2.3 The Seller reserves the right to modify the quantity of goods and/or services in the Order for justified reasons. In such cases, the Seller will notify the Buyer at the email address or phone number provided when the Order was placed and will refund the amount paid.

2.4 The invoice constitutes a sales-purchase contract in accordance with the applicable legislation.

2.5 The sales-purchase contract is considered concluded between the Seller and the Buyer at the moment the order is paid in full and received by the Buyer.

3. Liability

3.1 The Seller cannot be held liable for any damages of any kind that the Buyer or any third party may suffer as a result of the Seller fulfilling any of its obligations under the Order, or for damages resulting from the use of the purchased goods.

3.2 By creating an Account and/or using the Website and/or placing an Order, the User/Buyer expressly and unequivocally accepts the Website’s Terms and Conditions in their latest updated version, as communicated on the Website. The Buyer is directly responsible for the accuracy of the billing information provided. After creating the Account, continued use of the Website constitutes acceptance of any changes made to the Website’s Terms and Conditions.

3.3 The Website’s Terms and Conditions may be modified at any time by SC Maccetis SRL, and such modifications shall be binding on Buyers and Users from the date they are posted on the Website. Acceptance of the Website’s Terms and Conditions is confirmed by ticking the corresponding checkbox on the Website at the completion of the Order.

3.4 The information provided through this Website and through written or verbal communications between the Buyer and the Seller is obtained from sources considered valid and reliable, and is accurate and complete to the best of our knowledge, but is not exhaustive, and its accuracy cannot be guaranteed. SC Maccetis assumes no responsibility for incomplete information or potential errors appearing on the Website, but constantly strives to correct and update the information presented. The information used to describe the goods and/or services available on the Website does not constitute a contractual obligation on the part of the Seller, being used solely for presentation purposes.

3.5 In the event that certain goods or services are listed at an incorrect price on the Website, Maccetis reserves the right to modify or cancel any Order containing such goods/services. If the Order has been paid, Maccetis will refund the amount to the Buyer’s account. Maccetis reserves the right to correct system errors or unintentionally displayed incorrect prices. Due to market-specific fluctuations, product prices may change without prior notice. Although we strive for accuracy in displaying all information on the Website, mistakes are sometimes found. In these rare cases, we respectfully reserve the right to cancel an Order or remove a problematic item from the Order.

3.6 Maccetis shall not be liable for technical errors and inaccuracies appearing on the Website, typographical errors, incorrect documentation, illustrations, or images. The information presented on the Website is periodically updated, and improvements and/or modifications may be made at any time.

3.7 At any time, Maccetis reserves the right, without prior notice to the User and Buyer, to modify policies, Terms and Conditions, and to correct any errors appearing on the Website or in electronic/verbal communications.

4. Limitations of Liability

4.1 Maccetis makes every effort to describe products as accurately and explicitly as possible, but cannot guarantee the accuracy or completeness of the information provided through the Website, blog, social media, telephone conversations, or email correspondence. It is the Buyer’s responsibility to research the appropriate method of use and the safety information for each product they intend to order, including all applicable legal regulations for the correct use and potential sale of the purchased products or of products manufactured using the purchased products.

5. Pricing Policy

All prices displayed on the Website in the English version are expressed in euros (EUR) and include VAT. Prices do not include shipping fees.

Discounts, reductions, and promotions are not necessarily cumulative. As a rule, the highest value discount applies. All promotions and price reductions displayed on the Website are valid while stocks last.

6. Order

6.1 The minimum order value is EUR 20 (excluding shipping fees), except for certain products. This requirement has been established to ensure efficient operations and is a necessary step in order to offer the best possible prices.

6.2 Orders can be placed by phone or email; however, we recommend placing orders online through the Website.

6.3 The Buyer must ensure that the Order has been placed correctly and that complete information has been provided, as any subsequent modification can only be made under certain conditions.

6.4 Products that are out of stock cannot be ordered, and the Seller cannot guarantee the sale price displayed on the Website. Stock availability is displayed in real time on the Website and may change at any time during the ordering process.

6.5 The Buyer will be contacted if a product is missing from the Order. If the Buyer does not respond or cannot be reached by phone within 2 working days, the Order will be shipped as is. The missing product must be ordered again, as the Seller will not ship it automatically at a later date.

6.6 The Buyer must check the received Order and contact the Seller within a maximum of 3 days if any discrepancies or errors are found. Notifications sent after this period will not be taken into consideration.

6.7 Maccetis reserves the right to select its clients/buyers. For justified reasons, Maccetis reserves the right to restrict the Buyer’s access to placing an Order or to certain payment/delivery methods, or to refuse to fulfill an order if, based on the Buyer’s conduct or activity on the Website, it considers that the Buyer’s actions could in any way harm Maccetis.

6.8 Order Cancellation

• If the order has been paid for, the products have been collected and packaged, but not yet shipped: for the cancellation of an order whose value has already been paid, the Seller will charge a restocking fee of EUR 2, which will be deducted from the amount refunded to the Buyer.
• If the order has been paid for and shipped: such an order cannot be canceled; if receipt by the Buyer is refused, the Seller will charge a restocking fee of EUR 2 and the full cost of return shipping.
• If the order has not been paid for and not shipped: cancellation can be made by phone or email; no fee will be charged.

6.9 Special Order with Delayed Delivery

All products marked as available for special order are prepared after payment of the order and may be delivered no sooner than 3 working days from the date the order is placed.
The delivery time may be longer, in which case the customer will be contacted by email or phone by the sales department to arrange all details.
We reserve the right to apply shipping fees for orders with exceptionally high weight or volume, in which case the customer will be contacted to agree on the details.
Please ensure that you select the correct product, in the quantity you require. Products available for special order cannot be returned, as they are prepared specifically upon the customer’s request.

7. Delivery

7.1 Within Europe, the shipping cost for an order under EUR 100 is EUR 10, while for transoceanic orders under EUR 150 the cost is EUR 25. For orders over EUR 100, shipping is free.

8. Plată

8.1 Payment Methods for Orders

Payment can be made by bank transfer based on the invoice issued by Maccetis or by online bank card payment.

8.2 Information Regarding Online Card Payments

Card data processing is carried out exclusively on the payment processor’s servers. Maccetis does not request or store any details related to the Buyer’s card.

Regardless of the currency of the Buyer’s account, transactions are carried out in EUR, at the Buyer’s bank exchange rate. No commission is charged for online card payments.

9. Return Policy

9.1 The Customer must verify the received Order and notify the Seller within 3 days if he/she found any differences, errors or non-conformities. Notifications sent after this deadline will not be taken in consideration. The products on the Site marked as special order are not subject to the right of withdrawal.

9.2 Any product return requires a RMA number, that the Customer must request from the Seller. This RMA number has to be clearly seen on the outside of the package/box the product is returned in. Without this mark, the takeover may be refused by the Seller.

9.3 One can return only products not complying with the specifications on Site at the time of the purchase, products misdirected by Seller or other volume/size than ordered by the Customer. Used, unsealed or incomplete sets of products can not be returned. The return shipping costs are supported by the Seller after the Seller agreed the shipping method.

9.4 The returned products must be in the same condition, which they were delivered in, original packaging with all accessories, intact labels and supporting documents, all properly packaged for their protection during transport. Return products presenting any physical changes, bumps, chipping, scratches, signs of excessive/improper use and/or unauthorized interventions etc., that can not be called up for sale are not accepted by the Seller.

9.5 Products returned due to quality issues will be inspected by the Seller on the basis of internal procedures. If the Seller does not find any quality problems, the refund will not be realized.

10. Complaints

10.1 All complaints regarding shortcomings in the packages, products noncompliance, billing errors and other products received than those previously ordered, must be made by the Buyer within 3 days from the day the products have been delivered. Complaints received after this period will not be considered.

10.2 In any case for product return, the conditions listed in Section 9 will be taken into consideration.

10.3 When recording a complaint, it is necessary to fill in the complaints form: Complaint form, this will be sent by e-mail or fax by the Customer to the Seller. If you can not download and fill out the complaint form, please contact us by phone and one of our operators at Elemental will take your provided data to complete the form.

12. Copyright and Intellectual Property Rights

12.1 The content of the Website, including but not limited to logos, static and dynamic images, text, video materials, and multimedia presented on the Website, is the exclusive property of Maccetis, with all rights obtained in this regard reserved, including through licenses for use or publication.

12.2 The User and the Buyer are not permitted to copy, distribute, transfer, use, reproduce, or display the content from the Website without the prior written consent of Maccetis SRL.

12.3 The User or the Buyer may copy, use, or transfer content from the Website only for personal or non-commercial purposes.

13. Fraud

Any attempt to access another User’s personal data, modify the content of the Website, or affect the performance of the server on which the malgus.ro Website and its subdomains operate will be considered an attempt to defraud Malgus’ systems and will trigger criminal investigation against the person or persons who have attempted such actions.

14. Disputes

Any dispute arising between the User/Buyer and Maccetis will be resolved amicably. If the conflict cannot be settled amicably, the disputes will be resolved by the competent Romanian courts in the Municipality of Cluj, Romania.

15. Final Provisions

We reserve the right to amend and update this document and our practices whenever we deem it necessary. If the User or Buyer does not express disagreement with the changes, it will be considered that they have tacitly agreed to all modifications to these terms and conditions.
